Sixth Consecutive U.S. Court Ruling Finds So-Called Defense of Marriage Act Unconstitutional
NORTHBROOK – Earlier today, the 2nd U.S. Circuit Court of Appeals in New York ruled thatthe so-called Defense of Marriage Act (DOMA) is unconstitutional and a violation of the Fourteenth Amendment. Speaker Boehner and Congressional Republicans have wasted $1.5 million in taxpayer money defending DOMA, even though now six consecutive courts have ruled the 1996 law unconstitutional.
“Today’s ruling is an important decision for equality,” said Schneider. “The courts and the people want to see the end of the so-called Defense of Marriage Act, and yet Rep. Dold and his Republican colleagues remain beholden to an extreme, ideologically-driven segment of their party. For Republicans to so readily waste millions of dollars defending a law that perpetuates a two-tiered system of marriage is both egregious and irresponsible. I’m calling on all Congressional Republicans to stop using taxpayer dollars defending what should not have been defended in the first place.”
In the 10th district, where Democratic Nominee Brad Schneider has earned the endorsement of the Human Rights Campaign for his strong support of equality in marriage, the workplace, and the military, this topic has been raised frequently on the campaign trail. Schneider’s Republican opponent, Rep. Dold, voted twice to support DOMA, opposes the Employment Non-Discrimination Act, and voted to delay the “Don’t Ask, Don’t Tell” repeal – all positions catering to the most extreme elements of his party and an extreme minority of the population.
